Following the court order reinstating DACA, effective December 7, 2020, USCIS will accept first-time requests for consideration of deferred action under DACA.
After more than three years of policy changes and attempts to limit and potentially cancel the program under the Trump administration, DACA program will return to how it existed during the Obama’s presidency.
This means that young immigrants who have never received DACA benefits can now apply as first-time applicants and that eligible applicants can apply for “advance parole” in order to leave the country temporarily and return lawfully.
